Land Ownership

The ASP Land Ownership policy is based on a simple principle of: "Australia for Australians".

Ultimately property rights and personal rights are the same thing.

As a matter of national sovereignty, we will make laws pertaining to land ownership in Australia, and use referenda to have such laws included in the constitution. Specifically, only an Australian citizen (except where they are a dual citizen with divided loyalties, or if they are permanently residing in a foreign country) may hold land title in either freehold or leasehold. Any non-citizen permanent or temporary resident may hold title to no more than 50 acres in rural areas, and 2 acres in suburban areas.

Where foreigners currently hold title to land greater than 50 or 2 acres depending on location, they will be given a 5 year period in which to sell their land to an Australian citizen, after which period if it is not sold, the Commonwealth may choose to remove title ownership and provide reasonable and just compensation. The second option open to a foreigner currently owning sizable land holdings is that they permanently reside in Australia, apply to become an Australian citizen (which may be expedited on a case by case basis), renounce their former citizenship and swear loyalty to Australia.

Additionally, to ensure the spirit of this law is upheld, an investigative unit will be empowered to ascertain whether foreigners (be they individuals or companies/ corporations) are attempting to own land by proxy by transferring title to Australian citizens who are bound under contract or oath to allow all such privileges and rights of ownership to aforementioned foreigners. In such cases where it can be determined that the land is held in proxy, the Commonwealth may immediately take title to the land and provide compensation, minus any fine that may be imposed by a jury for acting deceitfully against the Commonwealth. Moreover, a company/ corporation may only own land greater than 100 acres in rural areas, and 30 acres in commercial/ industrial zoned areas if it can be demonstrated that 100% of that company's shareholders are Australian citizens.

Before a referendum is enacted to implement this policy, we will take public submissions and hold open forums to debate the fine detail of this policy, such as the specific land sizes (greater or lesser) to be allowed to non-citizens, and the period of time (longer or shorter) to be given to such land owners to sell their properties or become Australian citizens.

Natural Resources

Among the natural rights of the colonists are these: First a right to life, secondly to liberty, and thirdly to property; together with the right to defend them in the best manner they can.

Australian natural resources (being the mineral and hydrocarbon wealth taken out of the earth) rightfully belong to the Australian public, and the Australian people deserve to receive their fair share of that wealth. As per our single ‘fair tax’ policy, as there will no longer be any company tax or GST, we cannot allow the mining companies (now mostly foreign owned) to take the mineral wealth of Australians without compensating the Australian commonwealth for it.

Thus, the Australian Sovereignty Party will enact legislation to reclaim the stolen natural resource wealth back for Australians. Our policy is to do the following:

  • We will nationalise all mineral and hydrocarbon deposits both on shore and offshore. Whatever is extracted from the earth shall be the property of the Australian public.
  • The government, on behalf of the Australian people, will tender out extraction contracts to mining companies. Mining companies may bid against each other for the extraction contracts, specifying how much they will charge the government to extract a given amount of the raw resources or what percentage they wish to keep as their cut, and detailing a minimum quantity to be extracted in a given period, and where relevant, may detail the cost to process and or refine the raw resources. Whichever bidding mining company offers the most cost effective deal shall be awarded with the extraction contract for the particular mine/ deposit, thus we will bring back real competition and efficiency back into the mining industry, and the over-all extraction costs will become lower.
  • Whatever is extracted/ processed/ refined is the property of the Australian people (less any percentage the mining company may be permitted to keep as part of their contractual arrangements). The government shall pool all the resources extracted from the many mining operations Australia wide (much like AWB used to do with wheat) and shall sell the resources on the international market for a good price. The Australian government reserves the right to sell such goods to the Australian market at lower cost to help promote Australian manufacturing and the building industry.
  • The mining companies may receive bonuses and commissions above the extraction fee they charge the government, provided they meet or exceed their quantity targets as contracted. They may also be fined where they are not meeting their targets.
  • It is worth noting here that the wealth generated from getting our fair share from Australian natural resources will be ploughed back into the public. If it becomes doubtful that the ASP can keep its promise of providing high quality and totally free public education, public health, and public transport, the wealth generated by nationalising our natural resources, above and beyond the finances generated from our single tax policy, will be there to fund such promises, because ASP will keep our promises, and will always serve the best interests of the Australian public.

Next to the right of liberty, the right of property is the most important individual right guaranteed by the Constitution and the one which, united with that of personal liberty, has contributed more to the growth of civilization than any other institution established by the human race.

As stated elsewhere in our policies, the Australian Sovereignty Party will ensure common law land rights are upheld and protected, where the law of trespass shall apply, and where a property owner may develop their property as they so desire (within reason) without the requirement to obtain unnecessary and unreasonable council permits.

With regard to farming practises, we will place a total ban on GM crops and animals, until an exhaustive and open enquiry has taken place into the side-effects of such products on both human health, and on the eco-system. Farmers will be encouraged to grow organic foods without artificial pesticides and herbicides, and will receive free training on best farming practices that help promote healthy soils and crops, and which do not cause any harm to the eco-system.

Cattlemen will once again be permitted to responsibly graze their animals on commonwealth land, which has been shown to help reduce fuel loads and prevent catastrophic bushfires.

Under the ASP's single ‘fair tax’ policy, there will be no more council rates or land taxes. A person's home will be their castle, and it will be possible to permanently subsist off one's own land if they so wish without any government interference, or any requirement to pay anything to any government.
